Charleston Cake Company
On acceptance of your final Invoice amount, we deem that you have “Accepted” these terms and conditions.
INFORMATION ABOUT US
www.charlestoncakecompany.co.uk and charlestoncakecompany.com are sites owned and operated by Charleston Cake Company (“we”, "us", "our" or "ourselves”).
We are registered with the Environmental Health Office, food hygiene certified and have a 5 Star food rating.
On placing an order via our email address, telephone or in person, you will receive an e-mail from us that we have received your order and payment of 50% of your order is required to hold your date in our cake diary. This amount is a non-refundable deposit. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the deposit has been received in cash or cleared funds and your order accepted.
PRICE AND PAYMENT
The price of each cake will be as quoted at time of request and will be liable to final acceptence from you in writing. The prices may include delivery and set-up costs. Please confirm at time of ordering. Full payment or balance payment is due in cash or cleared funds at least two months before the agreed delivery or collection date. If your order is within two months of the agreed delivery or collection date , full paymnet is due. Payments made for your cake or products and the deposit may be made by cash in person or via bank transfer. Prices are liable to change at any time, but any changes will not affect orders which we have already accepted.
If full payment or balance payment is not made in advance by seven weeks prior to the agreed delivery or collection date, your order will be cancelled and the date will be released to another customer. Additionally, your original deposit for the order will not be refunded as this will have covered our time for the appointment and design consultant process.
DESIGNS AND SPECIFICATIONS
All cakes shown on this website may be customised by colour, flavour and number of tiers. Specifications will be agreed with you in writing upon acceptance of your order. You may change your specifications at any time up to eight weeks prior to delivery, by written agreement with us and upon payment of any additional costs that may be notified to you. Whilst we will do our best to meet your requirements, please note that designs may vary slightly from those shown on our website and exact colour matches cannot be guaranteed.
If you would like to order a Bespoke Cake then we will be happy to discuss your requirements with you and provide a quote. A quote for a bespoke cake will lapse if it is not accepted by you within seven days. After this time a customer requesting the same date as yourself, will be given next option to place an order with us.
DIETARY REQUIREMENTS AND FOOD ALLERGIES
We are happy to accommodate all dietary requirements and will be pleased to discuss these with you. Please note however that all our cakes are produced in an environment where nuts, nut products, wheat, gluten products and dairy products are present.
DELIVERY OR COLLECTION
The prices may include delivery and set-up costs. Please confirm at time of order. All other areas of the United Kingdom and overseas countries will incur a delivery charge. We will deliver and set-up your cake at the venue notified to us in your order, or to such other place that has been agreed with us in writing. We aim to deliver and set-up your cake by at least 12.00 noon on the agreed delivery date.
If your order is for wedding cake pops, cupcakes, miniature cakes or cookies only then a delivery charge will apply. Please let us know if you wish to collect your cake from our trading address, so that we can arrange for it to be packaged securely and ready for your arrival.
You or your assigned wedding coordinator will be asked to sign a confirmation form upon collection or delivery and set-up of the cake. Please note that we cannot be held liable for any damage made to the cake after this time, for example due to transportation, inadequate placing, a non-level or weak table that the cake has been placed on due to direction by staff at the venue, storage after delivery or if the cake is affected by eviromental factors such as the weather. An overly warm room or venue can effect the exterior finish or even the inside of the cake causing buttercream to melt, which in turn will make the internal cake supports unstable. Please ensure the room or your venue is cooled to standard room temperature of between 20 °C - 23 °C. Please ensure that the table the cake is to be placed on at your venue is stable, level and can withstand the cake's weight.
Please note that your cake will be unavailable for collection or delivery unless full payment has been received by us in cash or cleared funds.
In order to keep your cake in perfect condition it must be stored out of sunlight and at room temperature of ideally 20 °C. Cakes should not be refrigerated prior to cutting or serving. Stacked cakes will be supported by wooden or plastic dowel food safe rods which should be carefully removed prior to serving. Some elements of your cake may not be edible i.e. diamante trimming, crystal decorations. These elements will be highlighted on your confirmation form.
It is your sole responsibility to ensure that all inedible items are removed from the cake prior to serving and we cannot accept any liability in that respect.
The specification and design of your cake shall, unless otherwise agreed (for example for Bespoke Cakes), remain at all times the property of Charleston Cake Company.
CANCELLATION AND REFUNDS
You may cancel your order by notice in writing to us at any time up to eight weeks before the agreed delivery or collection date and you will receive a refund of any monies paid above the 50% order balance deposit. If you have only paid the 50% order balance deposit, this amount will be forfeited. This is due to the amount of labour, time and costs associated with your order. We will refund any money due to you as soon as possible and, in any case, within 30 days originally used by you to pay for your purchase and using the same method of your original payment. If you cancel your order less than eight weeks before the agreed delivery or collection date, the full quoted price will become immediately due for payment.
Our liability to you is strictly limited to the price of the cake and we cannot be held responsible for any indirect losses which may happen as a consequence of any breach by ourselves of these terms however arising. However, this does not include or limit in any way our liability for any matter for which it would be illegal for ourselves to exclude, or attempt to exclude, our liability.
All notices given by you to us must be given in writing to Charleston Cake Company at firstname.lastname@example.org
We may give notice to you at either the e-mail or postal address you provide to us when placing your order or alternatively by posting notices on our website. You agree to all methods of communication. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter.
TRANSFER OF RIGHTS AND OBLIGATIONS
We may at any time transfer, assign or sub-contract the contract between us or any of our rights or obligations arising under it.
EVENTS OUTSIDE OUR CONTROL
We cannot be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by any act, event, non-happening, omission or accident beyond our reasonable control.
THIRD PARTY RIGHTS
Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
These terms and conditions together with our current prices, delivery details and contact details set out the whole of our agreement relating to the supply of a cake or cake related products to you. Nothing said by any member of Charleston Cake Company’s employees on our behalf should be taken as a variation of these terms and conditions or as an authorised representation about the nature or quality of our cakes. Save for fraud and fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
We have the right to revise and amend these terms and conditions from time to time. You will be subject to the terms and conditions in force at the time that you place your order with ourselves unless we notify you of a change to these terms and conditions and you do not reject the changes within 7 days of their notification.
LAW AND JURISDICTION
These terms and conditions will be governed by English law and any dispute arising from them shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
